About this tool

House Rent Allowance (HRA) is one of the largest tax exemptions available to salaried Indians. Under Section 10(13A) of the Income-tax Act, the lower of (i) actual HRA received, (ii) rent paid minus 10% of basic salary, or (iii) 50% of basic (metro) / 40% (non-metro) is exempt — but only if rent is actually paid and substantiated. Employers collect monthly rent receipts in January–March each year; without them they add HRA back to taxable salary in Form 16, increasing year-end TDS.

A few legal nuances matter. Landlord PAN is mandatory when annual rent exceeds ₹1,00,000 (CBDT Circular 8/2013); without it the employer is required to disallow HRA above that threshold. A revenue stamp of ₹1 is conventionally affixed on cash receipts above ₹5,000 (Indian Stamp Act, Section 30). Rent paid in cash above ₹2 lakh in a year violates Section 269ST and HRA may itself be denied — so most employees pay by UPI / bank transfer.

Frequently asked questions

+−Why do I need rent receipts to claim HRA?

Section 10(13A) of the Income-tax Act allows salaried employees to claim HRA exemption only if rent is actually paid. Employers ask for monthly receipts as proof. Without them, your employer adds back HRA to taxable salary at year-end (Form 16) and TDS rises.

+−When is the landlord's PAN mandatory?

If your annual rent is more than ₹1,00,000 (₹1 lakh) — i.e. more than ~₹8,333/month on average — the landlord's PAN must be quoted on the receipts and in Form 12BB submitted to the employer (CBDT Circular 8/2013). Without PAN you cannot claim HRA above ₹1L/yr.
